"WINNIE THE POOH" PROMOTION

HOW TO ENTER

  1. To be eligible to enter, individuals must purchase any two (2) x 'Winnie the Pooh' products from participating Coles supermarkets nationally between 01/03/07 and 31/03/07.
  2. Entrants must then enter online by visiting www.winniethepoohdownunder.com.au, follow the prompts to the competition entry page, input the requested details including the name of the adult submitting the entry, one child, the full product barcode number for each Winnie the Pooh product purchased, and an answer to the question "Why you would like your own party to celebrate 80 years of adventure with 'Winnie the Pooh'" in 25 words or less, and submit the fully completed entry form. Entries close 11:59pm AEST 31/03/07.

TERMS AND CONDITIONS

  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian residents aged 18 years or over. Employees and their immediate families of the Promoter, participating Coles supermarkets, and their agencies associated with this promotion are ineligible.
  3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter reserves the right to request winners to provide proof of age, identity and residency prior to awarding a prize. Identification considered suitable for verification is at the discretion of the Promoter.
  4. Incomplete, indecipherable, or illegible entries will be deemed invalid.
  5. Multiple entries are permitted, subject to the following: (a) only one entry permitted per specified purchase requirement; (b) each entry must be substantially unique; and (c) each entry must be submitted separately and in accordance with entry requirements. Unrecognised barcode numbers will not be accepted.
  6. Entrants must retain their product barcodes AND a photocopy of their Coles supermarkets purchase receipt(s) for ALL entries as proof of purchase. Failure to produce the required proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant's entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the promotional period but prior to entry.
  7. Each entry must provide the name of the one adult (aged 18 years or over) and one child.
  8. No responsibility accepted for late or misdirected online entries.
  9. The adults named on the entry form will be deemed the entrant. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  10. Promotion commences 01/03/07. Entries close 11:59pm AEST 31/03/07.
  11. This is a game of skill and chance plays no part in determining the winner(s). Each entry will be individually judged based on the creativity and enthusiasm of the answer provided to the question.
  12. The judges reserve the right to select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.
  13. The winners will be notified by telephone and mail.
  14. The Promoter's decision is final and no correspondence will be entered into.
  15. MAJOR PRIZE: The best valid entry, as determined by the judges, will win a "party to celebrate 80 years of adventure with 'Winnie the Pooh'" for their nominated child and up to nineteen (19) friends, as nominated by the winner. A maximum of twenty (20) children and twenty (20) adults can be accommodated at the party. The party will include catering snacks and refreshments, story telling and games and activities based on the stories of Winnie the Pooh, and special guest appearances "by two of your favourite friends". The value of the major prize is up to $2,500.00.
  16. The party will be held at one of the following venues (whichever is closest to the winner's residential address) on the date and time specified:
    • VIC: Como Historic House & Garden
      South Yarra
      Saturday 21st April
      10am - 12noon
    • NSW: Vaucluse House
      Vaucluse, Sydney
      Monday 16th April
      10am - 12noon
    • QLD: Hillstone St Lucia
      St Lucia, Brisbane
      Saturday 14th April
      10am - 12noon
    • SA: Botanic Gardens of Adelaide
      Thursday 19th April
      10am - 12noon
  17. In the event that the major prize winner resides more than 200km from the nearest party location (as specified above), the winner may elect to receive $2,500 cash (awarded in the form of a cheque) in lieu of the prize. Unless expressly stated within these Terms and Conditions, all other expenses associated with attending the party, including but not limited to flights or other transport to and from the party for all adults and children, accommodation, additional meals, and all other ancillary costs, are not included in the prize. The locations, dates and times of each party are non-negotiable. The prize must be taken on the date and time specified above, based on the availability of the Promoter's staff and special guests. Entrants must be available to attend the party on the relevant date specified in order to be eligible to claim the prize if selected as the major prize winner. If for any reason the original winner is not available to take the major prize at the relevant location and on the relant date as stipulated by the Promoter, then the original winner will forfeit their prize and the Promoter reserves the right to award the prize to the next reserve winner. If for any reason the major prize winner does not take an element of the major prize at the time stipulated by the Promoter, then that element of the prize will be forfeited.
  18. It is a condition of attending the party that all children must be accompanied by their parent or guardian at all times, before, during, and after the party. It is also a condition of accepting and participating in the party, that the winner's parent or guardian and of those other children attending the party, may be required to sign a waiver of liability and indemnity in respect of their participation and their child's participation, in a form determined by the Promoter in its absolute discretion.
  19. RUNNER-UP PRIZES: All entries other than the major prize winner will be divided by State/Territory of resident. Excluding the major prize winner, the best thirteen (13) entries in each of VIC, NSW, QLD and SA, and the best twelve (12) entries in each of the ACT, NT, WA and TAS, as determined by the judges, will each win a Winnie the Pooh prize pack valued at $20.00, containing selected Winnie the Pooh product/s as determined by the Promoter in its absolute discretion.
  20. Total prize pool value in each State/Territory is up to $2,760.00 in VIC, NSW, QLD and SA, and up to $2,740.00 in ACT, NT, WA and TAS.
  21. If any prize or part of any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
  22. If for any reason this competition is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, to cancel, terminate, modify or suspend the competition.
  23. Prizes are not transferable or exchangeable and are not redeemable for cash or vouchers, unless otherwise specified within these Terms and Conditions.
  24. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees to assign all of his or her rights, title and interest (including copyright) in and to their entry to the Promoter. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
  25. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  26. Any costs associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid.
  27. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person's computer related to or resulting from participation in or down-loading any materials in this competition.
  28. In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right to cancel, terminate, modify or suspend the promotion.
  29. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the appearance of either or both of the special guests or any performer at the party is cancelled for any reason beyond the reasonable control of the Promotr; (f) acceptance of any prize; or (g) attendance at or participation in the party.
  30. The Promoter collects entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. All personal details of the entrants will be stored at the office of the Promoter. As per the relevant Privacy Legislation, a request to access, update or correct any information should be directed to that office. The Promoter will collect and deal with entrants' personal information in accordance with the Promoter's Privacy Policy, which may be viewed online at http://www.disney.com.au/policy.html#oblig. In the event of any conflict between these terms and conditions and the Promoter's Privacy Policy, he Promoter's Privacy Policy will prevail.
